What we know

GDPR - The UK has become a ‘third country’ for personal data (like the US), meaning cross border data flows are subject to additional controls. An extension of current adequacy arrangements has been agreed and it is expected that an assessment on adequacy of the UK procedures will be resolved in the next 6 months.

VAT - Once out of the single market, import and export VAT will become payable.

People - The UK will control its VAT approach and from 1st January 2021 there will be changes to the system.

Free movement of people from and into the UK from EU countries will end.

Business travel to Europe to undertake work is subject to new rules and controls.

 

 

What we’ve done

GDPR - We have reviewed our supplier terms and conditions and made updates where necessary to mitigate this point.

None of our suppliers pose a material risk, although we anticipate that a reciprocal recognition arrangement will be agreed.

VAT – We are monitoring the situation and considering alongside the stocking plan and ROI issues.

People - We are working with our teams to ensure all EU nationals have applied for settled/pre-settled status to avoid difficulties. We will seek to utilise the new rights to work in the EU where our colleagues are required to work in Europe.

 

What you need to consider

GDPR – Top tip: it is best to know where your data is held, and, whether you are using any personal data that comes from the EU:

Complete a full risk assessment of personal data use and any cross-border transfers.

Ensure the necessary Standard Contractual Clauses needed to legalise the data transfers are in any contracts.

VATTop tip: VAT rules will change so make sure you are up to date with the current rules

Postponed accounting will be introduced - businesses will be able to account for import VAT on their return.

Distance selling arrangements for EU customers will no longer apply.

People - Many businesses have staff members who will need to apply for settled status.

Top tip: Know what your employees need to do:

All EEA nationals and their family members should have applied to continue living and working in the UK post Brexit.
